It's f%@king Saturday so nothing happens on a Sunday cause no mail on Sundays, Monday today they re-deliver the f%@ker, no notice of that the said UPS access point, next business day and not even which one. note one door has nothing e-mail doesn't specify so now I'm waiting till they drop it off there tomorrow and pick it up the day after, two days after the original projected delivery what the f%@k! No heads ups, no delivery times, late as f%@k, sitting with thumbs up my ass now plotting to go loiter at a 7/11 all damned day tommorow for a VIDEO GAME FROM THE BEST BUY FROM THE NEXT TOWN OVER just gonna buy a slurpie anytime the store hassles me. This company should be out of business. Period. I had the unfortunate experience of Verizon shipping my phone through them. Who even uses this horrid company? Nobody. Everyone uses FedEx or the USPS. I have a message for the driver before its shipped to wait until after 3 p.m. to deliver it as I am at work. So what does this driver do? Attempt delivery at 12 noon. And, when I call thinking I can go to a store to pick it up, I get 2 HOURS of runaround. Customer service says, "We have to schedule a one hour later callback to arrange you to pick it up" because I know the driver will again try to deliver it when I am not home. So after 3 hours of every department they have not listening to me, I get a man in my local area who is not even with the drivers and says I cannot go to the place to get it. I have to wait until after 4. Then they do not answer the phone there. So I have no idea where my phone is, and nobody who works for this company is competent. Why are they in business? Who treats their customers like we do not work for a living and have no jobs?

I cannot wait until this company is rightly put out of business as they are rude to customers, do not listen, their website is horrible and is nothing but a huge circle, and they cannot be gotten a hold of literally. Their local "stores" have nothing to do with the pickup for packages and they are rude as hell too. The man I dealt with was sexist as hell to me and hung up on me while I was trying to explain to him what a mess I was in all because THE DRIVER CANNOT FOLLOW DIRECTIONS.

I say there should be a class-action lawsuit for gross incompetence, horrid customer treatment and wretched service on an antiquated model. This company is thee worst package delivery service ever in the history of service. I would walk to get my package if I knew where the DRIVER WAS.

3. They keep sending me a paper invoice wasting our precious natural resources.
4. Their customer service is mostly over seas so the reps have thick accents and do not understand English or their own system very well.
5. They charge me higher amounts than what they quote me.
6. Their rates are among the highest in the business.
7. Their system is very complicated with UPS, UPS.com and the UPS Billing Center all being separate.

It was on a Friday evening. I live in an apartment complex and I really believe the driver just didn’t even attempt to find my apartment. I called customer service and complained. The person I spoke with the first time was really professional and nice. She had someone call me from a local delivery station and this woman was an ass. Just a rude bitch. She said my delivery did not have an apartment number. If it had an apartment number on it when it left Amazon and didn’t after UPS handled my package then that’s on UPS. I had a package delivered about 3 weeks ago. I was sitting on my couch and heard the driver throw the package against the door. I wish Amazon would stop using them and just go with fedex.

I was home during the time they allegedly delivered the package. Interestingly, with this package, I never received a tracking number or notice of delivery status. I found that strange because I have text, email, and live updates set. Additionally, the other packages I received that same week all had tracking numbers, alerts, etc. Fast forward, I had to file a claim to be reimbursed. That's when the trouble began. I haven't been able to get any packages delivered to my house. A supervisor told me I was placed on a low security risk for a year and would have to pick up my packages from an access point that I didn't authorize. I filed several complaints, but to no avail. It's actually worse. Just today, the last package was mailed from the merchant September 9th, and I still haven't gotten it. Dates were pushed back four times and they are purposely rerouting my packages as retaliation for filing the claim. As a matter of fact, I can prove it. UPS shows the package in question leaving one facility in TN and arriving 98 miles out in the next city in ONE minute, then to California. I live in Georgia, one state over from the shipping location,, Tennessee. I went to the distribution center that services Dacula, GA to speak with the supervisor about this situation and the driver, but that was pointless. She was unprofessional, yelling at all the customers, and didn't seem at all bothered. I recorded her and plan to send everything to corporate or pursue legal recourse. Someone has to stand up to them.

The store blamed the pandemic saying the warehouses are shut down on occasion for cleaning which messes up the schedule. That would have been nice to know ahead of time. Gate code entry option doesn't allow a non-numeric code (you need to hit "#" first or the numeric code does nothing)

Hard to get to an email option for UPS: most want to direct you into a FAQ. The one time I did get into an email option, I was limited to 500 characters, and had to specify that I was changing delivery instructions, which is disturbing. I looked for another option, and my message was deleted.

Great people at USP, but their connection to e-commerce is terrible. Very inconvenient, developed by people who apparently have never tried to use UPS.

UPS says the package is at the facility (around the corner from my business) but will need to be shipped back to the sender to be resent. And they will not talk to me because I am not the sender (though interestingly as a My Choice and Business customer, I should be able to change my delivery options... nope... doesn't work). What the heck? I mean, I have the tracking number, identification, etc. They won't let me pick up the package. This is unbelievably frustrating.The last time this happened, a package that had very expensive machine parts was lost in their facility. These parts were no long made and considered unobtainable. The UPS Store (Brick NJ) packaged it all up and then it was lost. Weeks later, I resigned myself to the fact they were gone (oh, UPS wasn't issuing a claim saying the parts had no proof of the claimed value... always something) and reached out to the original manufacturer to see of there was maybe some old stock available or a possibility of breaking out old tooling to remake the parts. The owner mentioned that he had received a strange package from UPS with these old parts in it. Evidently, UPS send the parts to them because the company name and city were stamped on the parts. After verifying with the sender, the company sent me my parts. UPS had washed their hands of the whole thing, and I got extremely lucky in locating them. End of rant. Why does UPS have to make it so difficult??

I received an email from UPS saying that my My Choice account would be canceled if I didn't login before October 7. I guess this is what happens if you don't use the account in a while. After recovering my user ID and resetting my password I logged in and was immediately presented with a page saying "We've updated the UPS Technology Agreement. We've updated the agreement since your last login.You must agree to the terms to continue." and had check a box with the following oath to continue: "I agree to and confirm that I've been given enough time to read and understand the UPS Technology Agreement, which contains important terms about my use of UPS Technologies, like terms limiting UPS's liability and my agreement on how disputes between UPS and me will be handled.∗" Below I have pasted the new UPS Technology Agreement which I have decided not to agree to and I am in the process of cancelling my My Choice account. For the "privilege" of getting enhanced tracking info and having some limited options to change delivery of packages, it isn't worth my time to read and understand this entire lengthy, lawyerly agreement and other accompanying documents and/or consult an attorney to find out what it all really means and, I suspect, agree to forfeit rights I would otherwise have to legal remedies in case of a dispute with UPS.

I also found out the hard way that if you send email directly to UPS's customer service via the email address on their website you get a robo-response saying this: "Dear UPS Customer, Emails sent directly to customerservice@ups.com or customer.service@ups.com are not monitored or received." They will only accept your communication if you enter it in their webform which, of course, means you don't have your own copy of the message and they can limit the size of your message, which indeed they do, to max 500 characters. So why post your email, UPS, if you don't want anyone sending direct email to it? Thanks, UPS, for the thinly disguised raised middle finger, reminding me that I'm not your customer, the shippers who pay you to deliver stuff are, and we who are the recipients of those packages are inconveniences to be "managed" and subjugated for purposes of cost control.

“Customer” means the Person that is your employer, but is not a Service Provider, (1) and that has been assigned the UPS Account you use to register the first UPS Technology you access, if a UPS Account is required for such registration, (2) and that has been assigned the first UPS Account you use with the UPS Technology you access, if a UPS Account is not required for registration but is required for use, or (3) when the first UPS Technology you access does not require a UPS Account for registration or use.

“Service Provider” means a third party engaged by a UPS customer to assist such UPS customer in managing its shipping activity with the UPS Parties, including Billing Data Service Providers, that has been approved by UPS in writing to perform such services for the UPS customer; provided however, UPS Affiliates may serve as Service Provider without a written approval by UPS.

“Service Provider Employee” means an employee of a Service Provider.

“You” or the possessive, “Your,” means, as applicable: (i) you as an individual, if you are entering into this Agreement as an individual on behalf of no other third party for your own personal use of the UPS Technologies; (ii) you as an individual and Customer, if you are accessing UPS Technology as part of your responsibilities as an employee of Customer; or (iii) you as an individual and your employer, if your employer is a Service Provider to a UPS customer and you are accessing UPS Technology as part of your responsibilities as a Service Provider Employee to perform services for the benefit of a UPS customer.

You represent and warrant You have reached the age of legal majority and, if applicable, You can form legally binding contracts under applicable law on behalf of Yourself, the Customer or Service Provider related to the UPS Technology. If at any time You are no longer authorized to form legally binding contracts under applicable law on behalf of Yourself, the Customer or Service Provider, as applicable, You may no longer use UPS Technology on Your own behalf or on behalf of such Customer or Service Provider.


General Terms and Conditions

1. Definitions. Capitalized terms used in this Agreement have the meanings set forth on General Terms and Conditions Exhibit A attached hereto and End User Rights Exhibit A . In the case of any conflict between the terms of the End User Rights and these General Terms and Conditions, these General Terms and Conditions shall control.

2. License Grant.

2.1. Scope. UPS hereby grants to You and You accept, subject to the terms and conditions of this Agreement, a limited, revocable, non-sublicenseable, non-exclusive, non-transferable, license to use or access, as applicable, the UPS Technology and associated Technical Documentation in the Permitted Territory for such UPS Technology. The End User Rights contain additional general license rights and restrictions, as well as UPS Technology-specific license rights and restrictions.

2.2. General Restrictions – UPS Materials and Software. You shall not, and shall cause Your employees and agents not to, sublicense, disclose or transfer the UPS Materials to any third party without the written consent of UPS. You agree not to modify (including corrections to the Software), reproduce, rent, lease, lend, encumber, distribute, redistribute, remarket or otherwise dispose of the UPS Materials or any part thereof without the consent of UPS, and hereby waive such rights granted under applicable law. You agree not to duplicate the Software, except as required for its use in accordance with this Agreement, provided that You may make one (1) back-up copy of the Software solely for archival purposes. Such back-up copy shall include UPS’s copyright and other proprietary notices, and shall be subject to all the terms and conditions of this Agreement. Notwithstanding anything to the contrary in this Agreement, You may not use the Software on an outsourced time-share or service bureau basis.

3. Export Law Assurances. You acknowledge that all UPS Materials provided hereunder are subject to the U.S. Export Administration Regulations (“EAR”) administered by the U.S. Department of Commerce's Bureau of Industry and Security, as well as other U.S. laws and regulations. You agree to comply with the EAR and all applicable U.S. laws in your handling and use of all UPS Materials provided hereunder and to not export or reexport the UPS Materials except as authorized by the EAR, U.S. and other applicable laws. Without limiting the generality of the foregoing, you agree, represent and warrant that no UPS Materials will be accessed from, downloaded in, released in, carried to, transferred to, transshipped through or to, exported to, or reexported to (1) the Restricted Territory (or a national or resident thereof) or (2) any person, entity or organization on the U.S. Treasury Department’s list of Specially Designated Nationals or the U.S. Department of Commerce’s Denied Persons List or Entity List. The countries and territories considered Restricted Territory and the persons, entities or organizations on the aforementioned lists may change from time to time. You agree to stay current with and comply with this provision notwithstanding any such changes. 4. UPS Materials.

4.1. Ownership of Intellectual Property Rights. You hereby acknowledge and agree that UPS owns all right, title and interest in and to, or has the right to license to You, the UPS Materials. You acknowledge that You have not acquired any ownership interest in the UPS Materials and will not acquire any ownership interest in the UPS Materials by reason of this Agreement. You will not at any time do or knowingly permit to be done any act or thing that would in any way impair the rights of UPS or its licensors in and to the UPS Materials. UPS and its licensors reserve all rights pertaining to the UPS Materials not specifically granted herein.

4.2. Changes to UPS Materials and UPS Technology. UPS may update, alter, modify or supplement any or all of the UPS Materials and/or UPS Technology at any time.

5. Support Services.

5.1. Support and Maintenance. From time to time UPS, in its sole discretion, may, in response to Your request, choose to provide support or maintenance for the Software (“Support Services”). You hereby authorize UPS and its authorized agents (the “Support Providers”), in order to provide Support Services, to access the Software, other applications which You may be using in conjunction with the Software and Your computer systems either (1) remotely, via the Internet or other means (which may require the installation of additional software on Your computer systems by UPS or the Support Providers) (“Support Software”), or (2) through on-site visits at specific times as mutually agreed upon by the parties. Each support session using Support Software will be separately approved by You. During such sessions UPS may see the Software as operating on the Your computer system and UPS may assist You in making modifications to Your computer systems. You further grant UPS and Support Providers the right to manipulate and modify the Software and Your computer systems, applications, files and data as reasonably necessary to provide You with Support Services. However, You agree that any Support Services will be provided at UPS’s discretion and nothing in the Agreement shall be interpreted to obligate UPS to provide any Support Services.

5.2. Access to Proprietary Information. You acknowledge and agree that You may disclose, or that UPS or the Support Providers may observe, Your information and data during the provision of Support Services by UPS or the Support Providers; and that such information and data shall be deemed non-confidential and thus, not covered by General Terms and Conditions Article 7, unless UPS has agreed otherwise in a signed confidentiality agreement separate from this Agreement. In addition, You acknowledge that the remote communications sessions utilized by UPS or the Support Providers may be implemented through the Internet, which is inherently insecure, and You agree that UPS or the Support Providers shall not be liable for any security breaches occurring on the Internet. You should take the foregoing into account when requesting Support Services from UPS or Support Providers.

6. Suspension; Term and Termination.

6.1. Suspension of Rights. UPS may suspend Your rights to access any part of the UPS Systems through the UPS Technology or as necessary in UPS’s sole discretion including without limitation, to (1) prevent access to any part of UPS Systems or the UPS Technology that is not in compliance with the terms and conditions of this Agreement; (2) correct a material error in the UPS Systems or the UPS Technology or (3) comply with a law, regulation or rule or any ruling of a court or other body of competent jurisdiction.

6.2. Term. This Agreement shall become effective upon Your assent by clickthrough below and shall remain in full force and effect thereafter until terminated as provided herein (the “Term”).

6.3. Hosted UPS Technology. Certain UPS Technology is hosted by UPS, UPS Affiliates or vendors of UPS or UPS Affiliates. Hosted UPS Technology is hosted on servers in the United States of America and is scheduled to be available twenty-four (24) hours a day, seven (7) days a week (other than when unavailable for maintenance); however, UPS does not guarantee the availability of hosted UPS Technology, or that access will be uninterrupted or error-free. UPS reserves the right to interrupt, limit, or suspend hosted UPS Technology from time to time for purposes of maintenance, upgrades and similar reasons. You agree that neither UPS nor UPS Affiliates shall be held responsible or liable for any Damages arising from any interruption, suspension or termination of hosted UPS Technology, regardless of the cause.

6.4. Termination.

a. Either party may terminate this Agreement, and UPS may terminate any or all licenses to the UPS Technology granted hereunder, for convenience at any time upon written notice to the other party.

b. Notwithstanding the foregoing, this Agreement shall terminate without any further action needing to be taken by UPS (1) upon a breach of General Terms and Conditions Article 3, 7 or 10, or General Terms and Conditions Sections 2.2 and 4.1 (third sentence); (2) in the event of Your bankruptcy, commencement of bankruptcy, corporate reorganization, civil rehabilitation, concordat, special liquidation or any other insolvency proceeding with respect to You, or if You shall have a receiver, administrator, administrative receiver or liquidator appointed or shall pass a resolution for winding up, or a court shall make an order to that effect, (3) if You are a partner in or Customer or Service Provider is a partnership and such partnership is dissolved, or (4) upon deletion of Your UPS profile.

6.5. Effect of Termination.

a. Upon the termination of this Agreement for any reason whatsoever all licenses granted hereunder shall immediately terminate and You shall immediately cease and desist from all access to and use of the UPS Materials, and destroy all UPS Materials in Your possession or control.

b. Upon termination of any license to a UPS Technology, You shall immediately cease and desist from access to and use of such UPS Technology and associated UPS Materials and destroy all such associated UPS Materials in Your possession or control.

6.6. Survival of Terms upon Termination. General Terms and Conditions Articles 1, 7-9, and 12; and Sections 4.1, 6.5, and 6.6; the Articles and those Sections of the End User Rights identified in End User Rights Section 10.3 ; and the Articles and those Sections of the Information and General Use Policies identified in Article 4 of the Information and General Use Policies shall survive the termination of this Agreement for any reason.

7. Confidential Information, Trade Secrets, Information.

7.1. Disclosure. During the Term and thereafter, You shall not use (except as permitted in connection with Your performance hereunder), disclose or permit any Person access to any Trade Secrets (including, without limitation, any Trade Secrets contained in the UPS Materials). During the Term and for a period of five (5) years thereafter, except as otherwise mandated by law, You shall not use, disclose, or permit any Person access to any Confidential Information, except as permitted in connection with Your performance hereunder. You acknowledge that if You breach this General Terms and Conditions Article 7, UPS may have no adequate remedy at law available to it, may suffer irreparable harm, and will be entitled to seek equitable relief. You agree to protect such Confidential Information and Trade Secrets with no less diligence than You protect Your own confidential or proprietary information. If disclosure to Confidential Information is required under provisions of any law or court order, You will notify UPS sufficiently in advance so UPS will have a reasonable opportunity to object.

7.2. Aggregation. You shall not aggregate the Information or derive or develop information, services or products that use the Information, other than as expressly permitted under this Agreement.

7.3. Data Export. You may not export, whether by (i) data export functionality built into the Software; (ii) extraction from the Software interface (e.g. screen scraping); or (iii) otherwise, any data from the UPS Databases and use such data for comparing shipping rates or delivery times with the shipping rates or delivery times of any third party that is not a member of the UPS Parties.

8. Warranties.

8.1. By Customer. You represent and warrant that (1) neither Customer nor You is headquartered in, incorporated in, a national or resident of, or the government of the Restricted Territory; (2) neither You nor Customer is a Person on the U.S. Treasury Department’s list of Specially Designated Nationals or a Person owned fifty percent or more by or under the control of any Person on the U.S. Treasury Department’s list of Specially Designated Nationals (as they may be amended from time to time and which, for convenient reference only, may be found at https://www.treasury.gov/ofac/downloads/sdnlist.txt and https://www.treasury.gov/resource-center/sanctions/Programs/Pages/Programs.aspx ) (each being a “Sanctioned Person”); (3) neither You nor Customer will use the UPS Technology in the Restricted Territory; and (4) neither You nor Customer will use the UPS Technology in connection with any business or transaction involving the Restricted Territory or a Sanctioned Person .

8.2. Disclaimers.

a. UPS PARTIES WARRANT THAT FOR NINETY (90) DAYS FROM THE DELIVERY TO YOU OF SOFTWARE THAT SUCH SOFTWARE SHALL MATERIALLY OPERATE AS DESCRIBED IN THE SOFTWARE’S CORRESPONDING TECHNICAL DOCUMENTATION. UPS’S SOLE LIABILITY FOR A BREACH OF THE FOREGOING WARRANTY SHALL BE TO REPLACE ANY SUCH SOFTWARE. EXCEPT AS STATED IN THE WARRANTY OF THE FOREGOING TWO SENTENCES, THE UPS MATERIALS ARE PROVIDED "AS IS WITH ALL FAULTS" AND IN THEIR PRESENT STATE AND CONDITION. NO WARRANTY, REPRESENTATION, GUARANTEE, CONDITION, UNDERTAKING OR TERM, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, AS TO THE CONDITION, QUALITY, DURABILITY, ACCURACY, COMPLETENESS, PERFORMANCE, NON-INFRINGEMENT OF THIRD PARTY RIGHTS, MERCHANTABILITY, QUIET ENJOYMENT, OR FITNESS FOR A PARTICULAR PURPOSE OR USE OF THE UPS MATERIALS IS GIVEN OR ASSUMED BY UPS AND ALL SUCH WARRANTIES, REPRESENTATIONS, CONDITIONS, UNDERTAKINGS AND TERMS ARE HEREBY EXCLUDED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, AS ARE ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE. UPS DOES NOT WARRANT THAT DEFECTS IN THE UPS MATERIALS WILL BE CORRECTED. NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY UPS OR ANY UPS REPRESENTATIVE SHALL CREATE A WARRANTY.

b. You furthermore acknowledge and agree that access by UPS or the Support Providers to Your computer systems, files and associated data pursuant to General Terms and Conditions Article 5 hereof is merely to facilitate Support Services on Your behalf, and You remain solely responsible for backing up Your computer systems, applications, files and data. ANY SUPPORT SERVICES OR SUPPORT SOFTWARE PROVIDED BY UPS OR A SUPPORT PROVIDER PURSUANT TO THIS AGREEMENT ARE PROVIDED “AS IS WITH ALL FAULTS”, AND UPS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING ANY SUCH SUPPORT SERVICES OR SUPPORT SOFTWARE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, UPS HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTY RIGHTS OR FITNESS FOR A PARTICULAR PURPOSE, RELATED TO SUPPORT SERVICES OR SUPPORT SOFTWARE PROVIDED UNDER THE AGREEMENT AND ALL ASSOCIATED ADVICE, DIAGNOSES AND RESULTS. YOU ACKNOWLEDGE AND AGREE THAT UPS WILL NOT BE LIABLE FOR ANY ERROR, OMISSION, DEFAULT, DEFICIENCY, OR NONCONFORMITY IN THE SUPPORT SERVICES.

c. THE UPS PARTIES DO NOT GUARANTEE CONTINUOUS, UNINTERRUPTED, OR SECURE ACCESS TO THE UPS SYSTEMS AND ACCESS TO SUCH UPS SYSTEMS MAY BE INTERFERED WITH BY NUMEROUS FACTORS OUTSIDE OF UPS’S CONTROL. THE UPS PARTIES ARE NOT LIABLE FOR ANY DAMAGES OF ANY TYPE CAUSED BY SUCH INTERFERENCE.

d. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTY, SO THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION MAY NOT APPLY TO YOU. THE AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM JURISDICTION TO JURISDICTION. YOU AGREE AND ACKNOWLEDGE THAT THE LIMITATIONS AND EXCLUSIONS OF LIABILITY AND WARRANTY PROVIDED IN THIS AGREEMENT ARE FAIR AND REASONABLE.

9. Limitation of Liability.

a. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON CERTAIN DAMAGES SUCH AS LIMITATIONS ON (I) INCIDENTAL OR CONSEQUENTIAL DAMAGES, (II) DAMAGES RESULTING FROM GROSS NEGLIGENCE OR WILLFUL MISCONDUCT AND (III) DAMAGES RESULTING FROM PERSONAL INJURY OR DEATH. ACCORDINGLY, THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION MAY NOT APPLY TO YOU AND ARE ONLY APPLICABLE TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION. IF YOU ARE DEALING AS A CONSUMER, YOUR STATUTORY RIGHTS THAT CANNOT BE WAIVED, IF ANY, ARE NOT AFFECTED BY THESE PROVISIONS.

b. THE UPS PARTIES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, MULTIPLE, INCIDENTAL, OR SPECIAL DAMAGES, LOST PROFITS, LOSS OF DATA OR DATA USE, LOST SAVINGS, OR COSTS OF PROCURING SUBSTITUTE GOODS ARISING OUT OF THIS AGREEMENT, DUE TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), DELICT, USE OF THE UPS MATERIALS OR OTHERWISE, EVEN IF THE UPS PARTIES HAVE BEEN ADVISED OF THE LIKELIHOOD OF SUCH DAMAGES OCCURRING. EXCEPT FOR THE LIMITATIONS OF LIABILITY SET FORTH IN END USER RIGHTS SECTION 1.1 AND GENERAL TERMS AND CONDITIONS SECTION 8.2, IN NO EVENT SHALL THE LIABILITY OF ALL THE UPS PARTIES FOR ANY DAMAGES (DIRECT OR OTHERWISE) OR PENALTIES OR LOSS, REGARDLESS OF THE FORM OF ACTION OR CLAIM, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), DELICT OR OTHERWISE OF ANY TYPE EXCEED, IN THE AGGREGATE, ONE THOUSAND UNITED STATES DOLLARS (USD $1,000), ANY CLAIM FOR DAMAGES IN EXCESS THEREOF BEING HEREBY WAIVED BY YOU.

c. FOR THE AVOIDANCE OF DOUBT AND CONSISTENT WITH THE SECOND PARAGRAPH OF THESE GENERAL TERMS AND CONDITIONS, THE PRESENTMENT OF THIS AGREEMENT (VERSION UTA 09072020 (UPS.COM)) MORE THAN ONCE TO YOU DOES NOT CHANGE THE UPS PARTIES’ TOTAL AGGREGATE LIABILITY ABOVE ONE THOUSAND UNITED STATES DOLLARS (USD $1,000).

d. CLAIMS NOT MADE WITHIN SIX (6) MONTHS AFTER THE FIRST EVENT GIVING RISE TO A CLAIM SHALL BE DEEMED WAIVED.

10. Use of Name and Publicity. Except as expressly provided in this Agreement, You agree that You shall not, without separate prior written consent of UPS in each instance, use in advertising, publicity or otherwise the name of the UPS Parties (including without limitation United Parcel Service of America, Inc.), or any partner or employee of the UPS Parties, nor any trade name, trademark, trade dress or simulation thereof owned by the UPS Parties.

11. Notices. Except as specifically provided in this Agreement, all notices, demands or other communications required or permitted hereunder shall be in writing and shall be given as follows:

If by You: by personal delivery, UPS Next Day Air® delivery (notice deemed effective one business day after dispatch); by facsimile or telecopier transmission if a transmission confirmation is received by the sending party (notice deemed effective on date confirmation is received); or by certified mail, return receipt requested, postage prepaid (notice deemed effective on tenth business day following placement in mail) to UPS, 35 Glenlake Parkway, Atlanta, Georgia 30328, attention: UPS Legal Department, facsimile: (404) 828-6912; and

If by UPS: by each method available to You as well as electronic mail (notice deemed effective on date of transmission); to the address, email address or facsimile number, as applicable, (1) of Your registration information for the UPS Technology as provided to UPS, (2) of a UPS Account You use with the UPS Technology or (3) if neither (1) nor (2) above apply, then to the address, email address or facsimile number, as applicable, that You have otherwise provided to UPS.

Either party may change its address, email address or facsimile number for notice through thirty (30) days’ prior written notice to the other party.

12. Miscellaneous.

12.1. Independent Parties. The parties are independent parties and nothing herein shall be construed as creating an employment or agency relationship, partnership, and/or joint venture between the parties. Neither party is granted any right or authority to assume or to create any obligation or responsibility, express or implied, on behalf of or in the name of the other party, or to bind such other party in any manner.

12.2. Waiver. No waiver of any provision of this Agreement, or any rights or obligations of either party under this Agreement, shall be effective, except pursuant to a written instrument signed by the party or parties waiving compliance, and any such waiver shall be effective only in the specific instance and for the specific purpose stated in such writing.

12.3. Severability of Provisions. By law, You may have certain rights that cannot be limited by a contract like this Agreement. This Agreement is in no way intended to restrict those rights. If any portion of this Agreement is found to be invalid or unenforceable, the remaining portion will remain in full force and effect to the fullest extent permitted by applicable law.

12.4. Assignment. This Agreement, including any rights, licenses or obligations under this Agreement, may not be assigned by You to any other Person or entity without the prior written consent of UPS. UPS may assign, delegate or transfer all or any part of this Agreement or any rights hereunder to any member of the UPS Parties without the need for any approval or consent from You. For these purposes, “Assignment” shall include, but is not limited to, any merger or sale of all or substantially all of the assets of the assigning party or any transfer of this Agreement, or any portion hereof, by operation of law or otherwise, or any sale or other transfer of thirty percent (30%) or more of the voting shares/interests of the assigning party or control thereof. In the event of any permitted Assignment of this Agreement, this Agreement shall be binding upon and inure to the benefit of each of the parties and their respective legal successors and permitted assigns.

12.5. Taxes. Any fees payable under this Agreement do not include any taxes and fees (including, but not limited to, any applicable withholding taxes and VAT or any other tax or fee) levied by any duly constituted taxing authority against the fees payable to UPS hereunder. You shall be solely responsible for the calculation of and payment of any such taxes to the relevant taxing authority, and shall not reduce the amount of the fees payable for such tax payment.

12.6. Governing Law; Jurisdiction and Language. This Agreement and any claim, case, or controversy arising out of or relating to this Agreement (whether for breach of contract, tort or otherwise) shall be governed by and construed in accordance with the laws of the State of New York, excluding (1) its conflict of law principles; (2) the United Nations Convention on Contracts for the International Sale of Goods; (3) the 1974 Convention on the Limitation Period in the International Sale of Goods; and (4) the Protocol amending the 1974 Convention, done at Vienna, April 11, 1980. The parties declare that they have required that this Agreement and all documents related hereto, either present or future, be drawn up in the English language only. Except where local law requires, consistent with valid entry into a binding agreement, the controlling language of this Agreement is English and any translation You have received has been provided solely for Your convenience. In the event You have entered into this Agreement by means of the Internet display of a translated version of this Agreement in a language other than U.S. English, You may view the U.S. English language version of this Agreement by accessing https://www.ups.com/us/en/help-center/legal-terms-conditions/technology-agreement.page . THE EXCLUSIVE JURISDICTION FOR ANY CLAIM, CASE, OR CONTROVERSY ARISING OUT OF OR RELATING TO THIS AGREEMENT (WHETHER FOR BREACH OF CONTRACT, TORT OR OTHERWISE) SHALL BE A FEDERAL OR STATE COURT IN ATLANTA, GEORGIA, AND THE PARTIES HEREBY CONSENT TO SUCH EXCLUSIVE JURISDICTION AND IRREVOCABLY WAIVE AND SHALL NOT ASSERT ANY DEFENSES BASED ON LACK OF IN PERSONAM JURISDICTION, IMPROPER VENUE OR INCONVENIENT FORUM. Notwithstanding the foregoing, if and to the extent subsequent separate or ancillary proceedings in another U.S. or foreign court are necessary in order to enforce a judgment of the court in Atlanta, Georgia, or otherwise as is necessary to provide complete relief and full resolution of all issues in dispute, the Parties may institute such subsequent separate or ancillary proceedings in any such U.S. or foreign court, and the Parties hereby consent to the non-exclusive jurisdiction of such court and hereby waive any defenses therein based on lack of in personam jurisdiction, improper venue or inconvenient forum. Notwithstanding anything herein to the contrary, UPS shall be entitled to interim relief or provisional remedies before any court having jurisdiction. You agree to the admissibility of computer records and electronic evidence in any dispute herein. For the avoidance of doubt, dispute resolution provisions contained in any agreement You have entered into with a member of the UPS Parties related to UPS services, including for example, the applicable UPS Terms and Conditions of Carriage/Service, shall govern whenever such provisions are applicable to any claim or controversy. SEE SECTION 12.15 AND EXHIBIT B FOR COUNTRY-SPECIFIC DEVIATIONS TO THIS AGREEMENT IF YOU ARE A RESIDENT OF OR YOUR REGISTERED OFFICE IS LOCATED IN ONE OF THE FOLLOWING COUNTRIES OR TERRITORIES: MIDDLE EASTERN COUNTRIES, BANGLADESH, INDONESIA, ISRAEL, THE UNITED STATES OF AMERICA OR PUERTO RICO.

12.7. Force Majeure. Neither party hereto shall be liable for the failure to perform any of its obligations under this Agreement or for any Damages if such failure is caused by any reason beyond its reasonable control including without limitation, any occurrence of any act of God, labor strike or dispute, industrial disturbance, governmental emergency order, plague, epidemic, pandemic, outbreaks of infectious disease or any other public health crisis, including, without limitation, quarantine or other employee restrictions, regardless of whether such an event is officially declared to be an epidemic, pandemic, or the like by the relevant authoritative body(ies), judicial or government action, emergency regulations, sabotage, riots, vandalism, electronic failure, major computer hardware or software failures, equipment delivery delays, acts of third parties, or act of terrorism.

12.8. Remedies. Any remedies provided herein are non-exclusive.

12.9. Compliance with Laws. Each party, in connection with its performance hereunder, shall strictly comply with all applicable laws, rulings, and regulations and shall take no actions which would cause the other party to be in violation of any laws, rulings or regulations applicable to it, including, where required, You as a licensee filing this Agreement with a governmental entity. You specifically acknowledge that the UPS Materials provided hereunder may contain encryption functionality. You acknowledge and agree that by downloading, importing or using the UPS Materials in any country or territory outside the United States you, not UPS, assume full responsibility for compliance with all the laws and regulations of such country or territory, including, without limitation, all laws and regulations governing the import, use, distribution, development, or transfer of encryption software or technology and all requirements of registration or licensing related to same.

12.10. Data Practices. In order to perform pickup and delivery services, and in connection with Your use of the UPS Technology, the UPS package delivery company in Your jurisdiction, whose name and address may be found under “Contact UPS” on the UPS Web Site for Your jurisdiction (“UPS Delivery Co.”), collects, processes and uses personal information. UPS Market Driver, Inc., 35 Glenlake Parkway, N.E., Atlanta, Georgia, USA 30328 and the other UPS Parties may receive personal information and use it as described herein .

The UPS Parties process personal information in accordance with applicable data protection laws. Without limiting UPS’s ability to collect, use, process, or disclose personal information as permitted by applicable law, You agree that UPS and other UPS Parties worldwide (i) may collect, use, process, or disclose personal information provided by You for purposes (the “Purposes”) that include providing UPS’s services, products, and support; handling Your payments, claims, requests, and UPS Accounts; communicating with You to provide tracking updates and information on special events, surveys, contests, offers, promotions, products, and services; providing advertising that may be tailored to Your interests; operating, evaluating, protecting, and improving UPS’s business; facilitating Your use of UPS blogs and social media; performing data analyses; monitoring and reporting compliance issues, including identifying and protecting against illegal or wrongful activity, claims, or other liabilities; exercising, establishing, and defending legal claims; and complying with UPS policies and legal obligations, and (ii) may transfer personal information provided by You to countries other than the country where the Shipment is tendered for service. You also agree that UPS may share personal information provided by You with third parties, including service providers, affiliates, resellers, joint marketing partners, franchisees, Your contacts upon Your request, government agencies, and other third parties such as shippers, consignees, or third-party payers and recipients (collectively, the “Recipients”). UPS may also use or disclose personal information provided by You in connection with complying with a legal obligation, cooperating voluntarily with law enforcement or other public or government authorities, to prevent harm or loss in connection with suspected or actual illegal or wrongful activity, and in the event UPS sells or transfers all or a portion of its business or assets. UPS is not responsible for the privacy practices of any non-UPS places, sites, platforms, or services.

You represent and warrant to UPS that when You or Your employees, agents or contractors (“Shipper Parties”) provide UPS Delivery Co. with personal information: (1) the Shipper Parties have collected the personal information lawfully, and have the right and authority to provide the personal information to the UPS Parties for any uses permitted under these General Terms and Conditions Section 12.10; (2) You or another Shipper Party have notified each individual identified by the personal information (including all package addressees), as required by applicable law, that UPS will be processing the personal information as permitted by this Section 12.10 and for any additional purposes UPS may have adopted which are in effect at the time of shipping, that the personal information may be provided by UPS to the Recipients set forth above, and that the personal information may be transferred to countries or territories other than the country or territory in which the UPS Parties originally collected the information (which countries or territories may not have the same data protection laws as the country or territory in which You originally provided the information); and (3) You have obtained informed and specific consent from any package addressee or recipient, as required by law, that UPS may send e-mail and other notifications related to the agreed shipment services.

You further agree to receive non-marketing telephone calls and text messages relating to the UPS pickup and delivery services (including, without limitation, collections calls and text messages) from or on behalf of UPS at any wireless telephone number assigned to Your account. You understand and agree that such calls or text messages may be prerecorded and/or delivered through the use of an automatic telephone dialing system and that Your wireless carrier’s message and data rates may apply to Your receipt of such calls and text messages at a cellular telephone number. You understand and agree that any telephone number(s) that You provide to UPS will be true, accurate, current, and complete, and You will promptly update any such number as necessary to keep it true, accurate, current, and complete.

12.11. Non-Exclusivity. Nothing in this Agreement shall be construed to preclude or restrict UPS in any way from entering into similar arrangements with any other Person or from dealing or contracting directly with mutual customers of the parties.

12.12. Entire Agreement; Amendment. This Agreement constitutes the entire understanding and agreement between the parties with respect to the subject matter of this Agreement and supersedes any and all (1) prior or contemporaneous representations, understandings and agreements related thereto and (2) any prior versions of the UPS Technology Agreement between UPS and You, all of which are merged in this Agreement. Such merger will not be effective as to Software. The UPS Technology Agreement current at the time You receive a particular version of the Software will govern Your use of such Software version at all times. Any Corporate Technology Agreement between UPS and Customer, whether entered into before or after the date of this Agreement, shall supersede this Agreement. Any UPS Technology Agreement between UPS and You having a version more recent than Version UTA09072020 shall supersede this Agreement. The superseding of any prior agreement shall not abridge UPS’s rights against You as a result of any violation or breach of such prior agreement before the date of this Agreement. This Agreement may not be modified or amended except by a writing signed by authorized representatives of the parties to this Agreement; provided, however, UPS may modify the End User Rights pursuant to End User Rights Section 10.2 and the UPS Materials and UPS Technology pursuant to these General Terms and Conditions Section 4.2. A writing with electronic signatures shall not qualify to modify or amend the Agreement.

12.13. Waiver: European Union Notices. If You are a resident of or Your registered office is located in any country within the European Union and/or the European Economic Area, including the United Kingdom regardless of whether it remains in the European Union, You waive all notices, acknowledgements and confirmations relative to contracting by electronic means which may be required under Articles 10(1), 10(2), 11(1) and 11(2) of EU Directive 2000/31/EC as implemented in Your jurisdiction (including, in the UK, which may be required by the equivalent provisions of the Electronic Commerce (EC Directive) Regulations 2002 as may be amended or replaced from time to time, following the UK’s exit from the European Union) in respect of Your use of the UPS Technology. To the extent that You have a statutory right to withdraw from this Agreement in the first fourteen (14) days after Your acceptance, You hereby expressly renounce the 14-day right of withdrawal in exchange of UPS making UPS Technologies available to You immediately upon entering in this Agreement.

12.14. NOTICE: Processing of Personal Information pursuant to UPS Privacy Notice. You hereby acknowledge that personal information may be processed as set forth in General Terms and Conditions Section 12.10. You also agree that where You are the package addressee or recipient, You have received notice of the processing and use of personal information as described in General Terms and Conditions Section 12.10.

12.15. Country-Specific Terms. If You are a resident of or Your registered office is located in one of the countries or territories listed below, the terms of Exhibit B shall apply to You. In the case of conflict or ambiguity between any provision contained in the body of these General Terms and Conditions and any provision contained in Exhibit B, the provision contained in Exhibit B shall prevail if Exhibit B applies to You.

a. Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, UAE, Jordan, Tunisia, Algeria, Djibouti, Iraq, Lebanon, Libya, Morocco, and Mauritania (“Middle Eastern Countries”).

b. Bangladesh, Indonesia, Israel, the United States of America and Puerto Rico.


EXHIBIT A

DEFINITIONS- GENERAL TERMS AND CONDITIONS

Affiliates means third parties that control, are controlled by, or under common control with, whether directly or indirectly, a Person. For purposes of this definition, the term “control” (including with correlative meanings, the terms “controlled by” and “under common control with”) means the possession directly or indirectly of the power to direct or cause the direction of the management and policies of an entity, whether through the ownership of voting securities, by trust, management agreement, contract or otherwise.

Agreement is defined in the second paragraph of these General Terms and Conditions.

Alternate Billed Shipment(s) means shipments tendered to the UPS Parties on Your behalf by another Person where such shipments are charged against Your UPS Account.

Assignment has the definition provided in General Terms and Conditions Section 12.4.

Billing Data Service Provider means a third party services provider (1) hired by You for providing services for You to close the Customer Billing Cycle, and (2) who has been identified to UPS by You for receipt of Billing Data from UPS to You via the UPS Systems, using the approved secure transfer method which may be modified from time to time by UPS in accordance with this Agreement.

Confidential Information means any information or material, other than Trade Secrets, that is of value to UPS and is not generally known to third parties, or that UPS obtains from any third party (including without limitation the UPS Parties) that UPS treats as proprietary whether or not owned by UPS. Confidential Information shall include Information. Confidential Information shall not include information that You can show is: (1) known by You at the time of receipt from UPS and not subject to any other nondisclosure agreement between the parties; (2) now, or which hereafter becomes, generally known to the public through no fault of You; (3) otherwise lawfully and independently developed by You without reference to Confidential Information; or (4) lawfully acquired by You from a third party without any obligation of confidentiality.

Customer is defined in the third paragraph of the General Terms and Conditions.

Damages means any claims, losses, damages, rulings, judgments and costs and expenses (including without limitation attorney’s fees).

End User Rights means the document available at

General Terms and Conditions means this document.

Inbound Shipments means shipments tendered to the UPS Parties for delivery to You.

Information means information provided from the UPS Systems (i) related to services provided by the UPS Parties or (ii) generated in connection with You shipping with the UPS Parties, including without limitation, Tendered Shipments.

Information and General Use Policies means the document available at .

Middle Eastern Countries has the definition provided in General Terms and Conditions Section 12.15.

Outbound Shipments means a shipment tendered to the UPS Parties by You.

Permitted Territory means for any UPS Technology those countries and territories associated with such UPS Technology on End User Rights Exhibit C .

Person means any individual, corporation, limited liability company, partnership, joint venture, association, joint stock company, trust, unincorporated organization or other legal entity.

Purposes has the definition provided in General Terms and Conditions Section 12.10.

Recipients has the definition provided in General Terms and Conditions Section 12.10.

Restricted Territory means those countries or territories subject to a comprehensive economic sanctions program administered by the U.S. Department of the Treasury, Office of Foreign Assets Control (“OFAC”) or to any other general prohibition on the use, exportation, or reexportation of the UPS Technology under U.S. sanctions or export control laws. Countries or territories subject to OFAC embargo or sanctions can change at any time. For Your convenient reference only, the following links provide information pertaining to such countries or territories: https://www.treasury.gov/resource-center/sanctions/Programs/Pages/Programs.aspx , and https://www.bis.doc.gov/complianceandenforcement/liststocheck.htm .

Service Provider has the definition provided in the third paragraph of the General Terms and Conditions.

Service Provider Employee has the definition provided in the third paragraph of the General Terms and Conditions.

Shipper Parties has the definition provided in General Terms and Conditions Section 12.10.

Software means those items of UPS Technology that (i) are software and that are provided by UPS to You under this Agreement, (excluding sample computer software code) and any associated Technical Documentation, and (ii) any Updates thereto to the extent provided by UPS to You under this Agreement.

Support Services has the definition provided in General Terms and Conditions Section 5.1.

Support Software has the definition provided in General Terms and Conditions Section 5.1.

Support Providers has the definition provided in General Terms and Conditions Section 5.1.

Technical Documentation means collectively any and all documentation and/or sample computer software code regarding the UPS Technology or the UPS Marks provided or made available to You by UPS hereunder.

Tendered Shipment means a shipment tendered (i) by or for You to the UPS Parties for delivery or (ii) by a third party to the UPS Parties for delivery to You, which can be an Outbound Shipment, Alternate Billed Shipment or Inbound Shipment.

Term has the definition provided in General Terms and Conditions Section 6.2.

Trade Secret means any information of UPS or that UPS acquired from a third party (including without limitation the UPS Parties) which is not commonly known by or available to the public, which (1) derives economic value, actual or potential, from not being generally known to and not being readily ascertainable by proper means by other persons who can obtain economic value from its disclosure or use, and (2) is the subject of efforts that are reasonable under the circumstances to maintain its secrecy.

Update(s) shall mean maintenance, error corrections, modifications, updates, enhancements or revisions to the UPS Materials.

UPS means UPS Market Driver, Inc.

UPS Account means any shipping account assigned to You by a member of the UPS Parties, including, without limitation, those accounts assigned to users of UPS.com shipping known as “temporary accounts” and UPS Freight shipping accounts.

UPS Databases means databases of proprietary information related to the shipping services of the UPS Parties and distributed with or for use with Software.

UPS Delivery Co. has the definition provided in General Terms and Conditions Section 12.10.

UPS Marks means the word mark “UPS” as shown in various trademark registrations including but not limited to U.S. Trademark Registration No. 966,724, and the mark “UPS & Stylized Shield Device” as shown below and as shown in various trademark registrations, including but not limited to U.S. Trademark Registration Nos.: 2,867,999, 2,965,392, 2,973,108, 2,978,624, 3,160,056 and European Community Trademark Registration Nos.: 3,107,026, 3,107,281, and 3,106,978.

UPS

UPS Materials means collectively the UPS Technology, the UPS Databases, the Technical Documentation, the Information, the Software, the UPS Marks, and the UPS Systems.

UPS Parties means UPS and existing Affiliates, and their respective shareholders, officers, directors, employees, agents, partners, third party suppliers and third party licensors.

UPS Systems means the UPS computer and network systems accessed by the UPS Technology.

UPS Technology means those products identified on End User Rights Exhibit B .

You is defined in the third paragraph of this Agreement.

EXHIBIT B

COUNTRY SPECIFIC AMENDMENT TO THE GENERAL TERMS AND CONDITIONS

If You are a resident of or Your registered office is located in any country or territory identified in Section 12.15 of the General Terms and Conditions, the following terms replace or modify the referenced terms of the General Terms and Conditions. All terms of the General Terms and Conditions that are not changed by these amendments remain unchanged and in effect.

1. Middle Eastern Countries, Bangladesh, Indonesia, Israel, the U.S. and Puerto Rico.

1.1 Geographic Scope and Applicability.

a. You warrant and represent that You are a resident of or Your registered office is located in one of the following countries: Middle Eastern Countries, Bangladesh, Indonesia, Israel, the United States of America or Puerto Rico.

b. Subject to Section 1.1(a) of this Exhibit B above, You and UPS agree to modify the General Terms and Conditions as set forth in Section 1.2 of this Exhibit B below.

c. Except as amended as set forth herein, the General Terms and Conditions (including the Exhibits thereto) shall continue in full force and effect until expired or terminated and reflect the entire agreement between You and UPS regarding the subject matter hereof. To the extent that any provisions of this Exhibit B are inconsistent with the General Terms and Conditions, the terms of this Exhibit B shall govern solely with regard to the subject of the inconsistency.

d. In consideration of the promises and mutual covenants of the parties, You and UPS agree that the General Terms and Conditions shall be modified as set forth in Section 1.2 of this Exhibit B below.

1.2 Amendments.

a. If You are a resident of or Your registered office is located in one of the Middle Eastern Countries, Bangladesh, Indonesia or Israel, Section 9 of the General Terms and Conditions shall be deleted in its entirety and replaced with the following:

“9. Limitation of Liability.

9.1 Except as expressly stated in Section 9.2:

a. UPS Parties shall not in any circumstances have any liability for any Damages which may be suffered by the Customer (or any person claiming under or through the Customer), whether the same are suffered directly or indirectly or are immediate or consequential, and whether the same arise in contract, tort (including negligence) or otherwise howsoever, which fall within any of the following categories:

i. special damage even if UPS Parties was aware of the circumstances in which such special damage could arise;

ii. loss of profits;

iii. loss of anticipated savings;

iv. loss of business opportunity;

v. loss of goodwill;

vi. costs of procuring substitute goods arising out of this Agreement;

vii. loss or corruption of data or data use.

b. The total liability of UPS Parties, whether in contract, tort (including negligence) or otherwise and whether in connection with this Agreement or any collateral contract, shall in no circumstances exceed, in the aggregate, a sum equal to one thousand United States dollars (USD $1,000); and

c. You agree that, in entering into this Agreement, either it did not rely on any representations, whether written or oral, of any kind or of any person other than those expressly set out in this Agreement or (if it did rely on any representations, whether written or oral, not expressly set out in this licence) that it shall have no remedy in respect of such representations and, in either case, UPS Parties shall have no liability in any circumstances otherwise than in accordance with the express terms of this Agreement.

9.2 The exclusions in Section 9.1 shall apply to the fullest extent permitted by applicable law, but UPS Parties do not exclude liability for:

a. death or personal injury caused by the negligence of UPS Parties, their officers, employees, contractors or agents;

b. fraud or fraudulent misrepresentation; or

c. any other liability which may not be excluded by law.

9.3 For the avoidance of doubt, the presentment of this Agreement (version UTA 09072020 ) more than once to you does not change the UPS Parties’ total aggregate liability above one thousand united states dollars (USD $1,000).

9.4 Claims not made within six (6) months after the first event giving rise to a claim shall be deemed waived.”

b. If You are a resident of or Your registered office is located in one of the Middle Eastern Countries, Bangladesh, Indonesia, Israel, the United States of America or Puerto Rico, Section 12.6 of the General Terms and Conditions shall be deleted in its entirety and replaced with the following:

“12.6 Governing Law and Arbitration.

a. If You are a resident of or Your registered office is located in one of the Middle Eastern Countries, any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the DIFC-LCIA Arbitration Centre, which the Arbitration Rules of the DIFC-LCIA Arbitration Centre are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be the Dubai International Financial Centre. The language to be used in the arbitration shall be English. The governing law of the Agreement shall be the substantive laws of England and Wales. You hereby represent and warrant that You have the authority to enter into an agreement to arbitrate in accordance with this clause and any applicable law.

b. If You are a resident of or Your registered office is located in Bangladesh or Indonesia, any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Singapore International Arbitration Centre, which the Arbitration Rules of the Singapore International Arbitration Centre are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be the Singapore International Arbitration Centre. The language to be used in the arbitration shall be English. The governing law of the Agreement shall be the substantive laws of England and Wales. You hereby represent and warrant that You have the authority to enter into an agreement to arbitrate in accordance with this clause and any applicable law.

c. If You are a resident of or Your registered office is located in Israel, any dispute arising out of this Agreement, or the breach thereof, shall be settled by arbitration in accordance with the International Arbitration Rules of the Israeli Institute of Commercial Arbitration, which the International Arbitration Rules of the Israeli Institute of Commercial Arbitration are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The parties also agree to abide by and to perform the award or judgment of the arbitrator as the final decision respecting such dispute. The language to be used in the arbitration shall be English. The governing law of the Agreement shall be the substantive laws of England and Wales. You hereby represent and warrant that You have the authority to enter into an agreement to arbitrate in accordance with this clause and any applicable law.

d. If You are a resident of or Your registered office is located in the United States of America or Puerto Rico, any dispute arising out of this Agreement, or the breach thereof, shall be governed as set forth in Attachment 1 (Dispute Resolution in the U.S. and Puerto Rico) attached hereto.

e. Except where local law requires, consistent with valid entry into a binding agreement, the controlling language of this Agreement is English and any translation You have received has been provided solely for Your convenience. All correspondence and communications between You and UPS under this Agreement must be in the English language. In the event You have entered into this Agreement by means of the Internet display of a translated version of this Agreement in a language other than U.S. English, You may view the U.S. English language version of this Agreement by accessing https://www.ups.com/assets/resources/media/en_US/UTA.pdf .

f. Notwithstanding any other term of this Agreement, dispute resolution provisions contained in any agreement You have entered into with a member of the UPS Parties related to UPS Services, including for example, the applicable UPS Terms and Conditions of Carriage/Service, shall govern whenever such provisions are applicable to any claim or controversy.

c. If You are a resident of or Your registered office is located in one of the Middle Eastern Countries, Bangladesh, Indonesia or Israel, Section 12.16 shall be appended to the General Terms and Conditions as follows:

“12.16 Interpretation. The following rules of interpretation shall apply to this Agreement:

a. Section and Exhibit headings shall not affect the interpretation of this Agreement.

b. A person includes a natural person, corporate or unincorporated body (whether or not having separate legal personality).

c. Unless the context otherwise requires, words in the singular shall include the plural and in the plural include the singular.

d. Unless the context otherwise requires, a reference to one gender shall include a reference to the other gender.

e. Any reference to an English legal term for any action, remedy, method of judicial proceeding, legal document, legal status, court, official or any legal concept or thing shall, in respect of any jurisdiction other than England, be deemed to include a reference to what most nearly approximates to the English legal term in that jurisdiction.

f. A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time, whether before or after the date of this Agreement, and in the case of a reference to a statute is also to all subordinate legislation made under that statute whether before or after the date of this Agreement.

g. Any words following the terms “including,” “include,” “in particular” or “for example” or any similar phrase shall not limit the generality of the related general words.

h. Any reference to the word “merchantability” shall also be construed as meaning “satisfactory quality.””

d. If You are a resident of or Your registered office is located in one of the Middle Eastern Countries, Bangladesh, Indonesia or Israel, Section 12.17 shall be appended to the General Terms and Conditions as follows:

“12.17 Third Party Rights. A person who is not a party to this Agreement shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this Agreement, but this does not affect any right or remedy of a third party which exists, or is available, apart from that Act.”

We have one OMS that works maybe 3 of her paid 5.5 hours, and another OMS that feels she has as much say as the manager does and makes it known she is the “lead” OMS I’m sure they’re sleeping with each other, as well as the “safety supervisor” that works 2-3 hours a day and again.gets paid for 5.5 hours. After I was feeling better I went back to work for 4 days and I was confronted by the head of security at this location and was accused of stealing a package, something that would never had crossed my mind of doing. UPS had no real proof that it was stolen or the customer had it. I did my research and come to find out that the person that was getting that package was the top head of UPS security in that state. Sounds like a setup to me! I remember this stop very clearly and the woman signing for the package. I was fired, but never escorted out of the building(strange), no criminal charges were ever filled or any other information from UPS was ever sent to me about the issue(like it didn’t exist). Long story short, it seems like they wanted revenge because I got hurt working for them! They are the true criminals, not me.

Check the location of my package and it was sitting at a warehouse only 1 hr away from my place. 11th comes around... no package. Delivery date changed to 14th. Calls customer support they say they’ll contact them and that theres no reason it shouldn’t be able to be delivered that same day. She said that ups will get in touch with me.... noooope never happened. Weekend rolls around cant contact customer service as they don’t operate on weekends. 14th hits so I go check status and what do you know new delivery date set to the 15th. Call customer service 2 more times. First girl said they'd send a message to them, but i doubt the effectiveness of that after the first customer service experience. Second girl asked if i have been contacted by ups tell her no I haven’t. She asks me if i can pick it up myself. No im busy and dont have a ride up there and im not doing their f%@king job for them. I tell her that that package has been sitting in a ware house for days bow only 1 hr away from me and theres no excuse to not have it delivered by now. I asked her if she could call the warehouse and ask them to ship it that day since it was only 9 am. She keeps repeating what every else says the blatant lie “it will be delivered tomorrow”. UPS delivered a very heavy package to my neighbor's house. I was able to find it, but the homeowner did not want to give it to me. I called UPS to complain, and they 'opened an investigation'. A couple days later, they left me a VM saying the investigation was completed, and that they used GPS to verify it was at the right house. Their GPS needs some serious recalibration if that is the case. The VM gave me a number to call. When I called it, it was just the customer service line, and the person I spoke to said they could only start the process all over again. I asked to speak to a manager, or the person that 'did the investigation' and they said I would get a call from a supervisor in a couple hours. Its been over a week, no call.

SOMEHOW it manages to travel 303 miles in less than 24 hours but somehow it's scheduled to arrive Monday, which is more than 48 hours away. My package is SITTING IN A WAREHOUSE 40 MILES AWAY and it's gonna take them more than 48 HOURS TO DELIVER IT FROM THERE because apparently they "don't deliver on weekends". I tried to pick it up from the warehouse in person, but they told me it was "still on the truck" despite the fact that it has been at the warehouse for the past 10 HOURS.

Apparently, "Two-Day Shipping" is an absolute farce, considering it's being delivered in TWICE that amount of time, even though it's only been 24 hours since it was originally shipped and is now sitting just 40 miles away from me.

I used to love UPS since they always used to be more reliable than USPS and Fed-Ex and faster than DHL. But with my most recent experience... well, let's just say I'd actually rather use China...

I used to love UPS since they always used to be more reliable than USPS and Fed-Ex and faster than DHL. But with my most recent experience... well, let's just say I'd actually rather use China Post at this point. UPS is basically doing whatever they can to avoid delivering a package. Saying that I wasn't there to pick it up (I was, they literally just stuck a redirect notice on my door without even knocking), claiming that my address is invalid (I've received multiple packages at this address from them and many other services before), etc. At this point I'm starting to suspect that UPS is actually trying to steal my package, although as to why, I have no clue, since all it is is a motor controller for a high-end RC race car and a roll of high-quality solder.

I've had similar negative experiences with USPS and Fed-Ex as well. I'm at the point where I'm considering just hiring a private courier to pick things up from now on, because at this point there's no good option. Well, to be fair there IS Amazon, but they're only an option for their own store. Ironic how the "big bad evil company" is the ONLY ONE DOING THEIR JOB RIGHT.

After a total of FOUR times, finally got through their maddening phone tree to a live person- my first three attempts were deadends as eqch time phone tree guided me to nowhere with no options but to hang up. Fourth time, pushed right combo of options and got to talk to someone. After asking my simple question, he immediately put me on hold (wasnt told why) then after 10 minutes got disconnected. Two take aways: 1-Obviously they do NOT want phone calls. 2-UPS customer service SUCKS (And never knew it until today!)

I have packages delivered ahead of time and shows still in transit. They update the tracking four days late. They deliver my packages to all my neighbors instead of me. My neighbors have more of my stuff than I do. They take their sweet time for Ground shipments because they think you're a cheapskate who didn't opt for expedited and you should suffer for that. They have weather delays, traffic delays, system lags, delays because they have to pick up their kids from school, delays because their favorite soap operas are on and they'll take the packages when they feel like it, delays because they accidentally scanned their heads instead of the tracking numbers. The packages I've shipped lately have been about 1.5 times the cost when I checked UPS rates with other rates. I never willingly use UPS, at least not while I'm still coherent (arguably). They take 9 months to deliver a package 9 hours away. They take the package from California to New Mexico, then to Utah, then to New York and then back to Washington when the package was going from Los Angeles to San Francisco!!! They don't ring the bell or inform you when it's sitting outside rotting in the sun and rain, but they just drop the packages and be on their merry little f***ing way. Literally! They drop the G****n packages at the door like they're paying you back for f***ing their mothers. They leave packages right in the middle of the door hoping you step on them or worse, someone else takes off with it. I was waiting at the door in anticipation for my expensive package and I heard the b***h underhand the package like he was playing ring toss at the beach. So what does a rational person do after his new iPhone gets launched a perfect spiral from 30 yards? I ran the f**k after him but that b***h was gone. I hate UPS and hope all their trucks get picked up by a tornado and "delivered" onto their centers with the same downward motion that my iPhone received. I want to ship my middle finger Next Day Air right up their f***ing asses. Every problem you can have with a delivery happens with this excuse for a company. They drain all your energy and make you work for it when dealing with them. When you claim insurance or damage, there's always pushback and they never want to pay. I used UPS's Hold For Pickup option by signing up for their MyChoice account, and 3/3 times UPS still delivered to the house instead of access point. I don't get what their problem is. The last shipment that came to the house, I luckily caught the driver outside delivering the package as I was leaving, and he said he didn't get a notice for Hold For Pickup at UPS location. I took the packages and when I got in the house, both boxes had the UPS access point Hold For Pickup addresses on there and one was scribbled out. I don't know if they can't read, if they have bad intentions, they're just contrarians, they're just lazy, they want to piss off their customers or what. Why can't they just follow their own self-made processes? I called the access point location to see if maybe they refused the packages and the lady said the store has never refused a package and they have four packages currently on hold for other customers. Maybe my driver went rogue, I don't know. I've used FedEx before for the same exact hold at location option and not even ONCE did they mess up. I've done it about 40 times now and all 40 times have gone perfectly. I hate UPS and no wonder their corporate color is the color of...you know. It matches their level of service. Two days later and it arrives at the regional hub in Texas and then a day later, at the local distribution point where it is scheduled to be delivered the same day. Through a process which I still have yet to receive a sane explanation for, the package then disappears, resurfaces 160 miles away, then disappears again only to finally come to a rest in Seacaucus, NJ which after careful research I can confirm is not located in Texas. Shipment was literally less than 2 miles from my doorstep, yet as I write this, it sits 1,600+ miles (HALF A FREAKING CONTINENT) away. It passed through no less than 2 sorting facilities, being scanned at each, yet was allowed to continue on this transcontinental insanity tour of the UPS fulfillment system. I struggle to find the words and cannot for the life of me understand how a company with such glaring logistical issues could rise to the level which it has. Truly baffled.

Then, in the middle of the day, I get a notification saying that due to operating conditions delivery has been rescheduled. Since it's friday, now I have to wait the entire weekend, and finally this package is scheduled to be delivered on Tuesday. In the morning it literally says out for delivery. It is about a 3.5 hour drive from UPS Hub to my city in N. Alabama. Maybe I'll get it on the 4th. Come home on the 4th. No package. OK, no big deal. Due on the 5th. Check tracking number evening of the 4th. Hadn't moved from Atlanta. Hmmm. Go about my business on the 5th. No package. Check tracking again. Hadn't moved from Atlanta on the 5th. Everyone else in my family received their Amazon package through the prime delivery service but my package did not arrive. And UPS said there was a delay in operations, but wont give me a date for it to come?? I specifically paid for certain shipping because I need it by Monday.

This recent one has been sitting in another state for the past 6days due to severe weather conditions. I understand that is out of anyone’s control but put that shit in a van or bus and do what the f%@k you have to do to make it happen for your customers. Can’t get ahold of an actual person from UPS and even if I could they are barely understandable and their virtual helper just makes you more mad as it runs you around in circles. UPS third world ESL static phone support just notified me that it will continue to stay in Hodgkins, IL for another week and arrive on 9/9/20. I requested a refund on my next day air fee since the package will arrive 12 days late. They cheerfully told me they have suspended all refunds due to the Covid environment. I asked them where this was listed on their website. It took them 10 additional minutes to locate the buried message.

Have an item that has been in my local warehouse for 3 days, with delays due to "emergency situation and severe weather". While normally I wouldn't care, this just seems inaccurate. It's 30 minutes from me - let me pick it up at the warehouse if you don't have the capability to deliver it. Last time this happened, it was a cellphone I had ordered and had been told to go to the warehouse to pick up my item. I went and waited and was told: "The driver is not back yet", despite dispatch telling me they had already arrived. "The driver arrived but he's probably grabbing food"; I totally get it. However, 2 hours later and they had to send someone to go onto the driver's truck and physically check for the package. Total wait of 3.5 hours, despite calling ahead. I find it hard to believe that a logistics company can be so bad at logistics.

The day it was supposed to arrive and it was "out for delivery" I saw some jackass pull up in front of my house and fumble around for a few minutes in the UPS vehicle at the expected 10:30 delivery mark, clearly couldn't find the package he was supposed to deliver so he just took off and never came back that day! Normally I wouldn't be upset at a late delivery but the lives of delicate exotic animals were at stake since they can't tolerate staying in a bag for too long. The package ended up coming in the next day and half of the fish were dead. They even have a convenient excuse to use COVID to void their usual arrival guarantee that's supposed to refund your shipping when clearly this was a f#ck up from some idiot forgetting to load my package into the truck and not an actually flight delay from the pandemic. Don't trust UPS with live animals, they clearly don't give a dam! I'm sad that my poor fish had to suffer through their incompetence.

A tracking email that says my items were shipped ups...and that a label was created at 1230 today however ups did not pick them up today. FedEx would have picked them up same day. So now even if the packages get to michigan tomorrow they will sit at their facility all weekend and Monday being its a holiday and be attempted to be delivered on Tuesday when it is too late and with a signature required I will miss the delivery being I am at work during the day. So unbelievably pissed.

USPS is far quicker and way cheaper! I shipped a package from the local UPS store last Friday, August 28, 2020. It was supposed to be delivered Wednesday, September 2, but now has been delayed until 9:00 PM on Thursday, Sept. 3! Six days to go from North Carolina to Maine at a cost of $19.91.

I sent a similar package the next day, Saturday, August 29, from the U.S. Postal Service to the SAME ADDRESS. It arrived TODAY and only cost me $4.75!!!

UPS: 6 days at a cost of $19.91

It was then scanned into another facility equally an hour-ish away in a lateral direction at 11:44 am. Delivery date still 8/29. The package sat at that second facility until 8/31 10:45 pm - TWO WHOLE DAYS. No delivery date update - WTF? Yesterday, 8/31 I received a notice early in the morning that delivery would be yesterday by 9pm. Waiting, Waiting, Waiting, Waiting, NOTHING. It was logged into a facility 30 min from my house at 11:43 PM last night (8/31). Supposedly as of 4:08 am TODAY (9/1) is my new delivery date- we'll see. Guess I'll grab some popcorn and wait..... I have a store on etsy and we make reclaimed wood table tops. The UPS monkeys destroy 25% of the tops we send out. It doesn't matter how big or small they are, they will find a way to rip the packaging apart and drag the contents around until they scratch or crush or dent our tops. When I file claims they say that the packaging wasn't good enough. I've dropped our packaged tops out of our truck and even when they land on the corner they hold up well. We make our packaging from 3/4" cabinet grade plywood and treated Masonite hardboard. We glue and screw everything together and they still manage to rip them open. I feel that we owe the customer the top they ordered so I wind up making a new top and shipping it at my expense. I can't make any money doing that 4-5 times a month so
essentially, UPS has put us out of business. We are closing down, it just isn't worth it any more. I hope the monkeys at UPS all go to hell.

UPS took 10 days to ship a package from LA California to northeast Ohio. Delayed numerous times with no explanation and one explanation of “a transportation accident “. When the package did finally arrive the contents were significantly damaged even though it was well protected with bubble wrap. The shipper shipped a replacement that is now 7 days in transit and delayed beyond that. Meanwhile using FedEx I received a shipment from Japan (the other side of the planet) in 2 and a half days door to door. And a blister pack USPS 1st class mailing from Oregon in 3 days.
To suggest the current service from UPS is underwhelming is a gross understatement. Even their tracking system is a joke.
The only thing they seem to do well is clean the outside of their delivery trucks. Mind you, the insides are always filthy.
This was once a very reliable shipping company that currently is terrible!

At 12:30, an exception had occurred and it said “a later trailer arrival had caused a delay, we are adjusting plans to deliver your package ASAP”. Well it’s been about 24 hours and still no delivery date has been updated. I have done my SHARE of research and have found that this Hodgkins, IL UPS location has been messed up for a while. People have lost packages, have had packages sat there for weeks. Any insight? Has anyone else had this issue within the last few days? Did your new delivery date take a day or longer to update?

Five months ago I moved to South Korea. I packaged up an important box that contained my: important paperwork (birth certificate, family pictures, my college degree, my high school diploma, and SEVERAL certifications). I had this items packaged inside of a UPS store, paid for my shipping, and etc...

Well, to make a long story short, UPS--this piece of SHIT organization--lost my ENTIRE shipment. All of my valuable personal items just went into the ether. The MFers who answered the phone told me that, "Since we could not get in touch with you" (knowing full well that I was relocating to another f%@king country and therefore I was without cellphone service) they just decided to through my packages away!

I tried to dispute this on their website in a last ditch effort to get my things back, but the asshole commandeering the phone was very rude and did nothing to help me.

It is a damn power of attorney. It's an important document that I am PISSED about losing. After trying to get a real person, I finally did and he was from a call center in India and had no idea what I should do. I call my local UPS office and get told "gee that sucks" and when I demanded a refund they said, "Due to COVID UPS isn't giving refunds." $45 dollars. I WILL NEVER USE UPS AGAIN!

I then went online and checked there and the same thing.but that afternoon a driver showed up with the package but it was not complete so i tried to refuse the package but the driver would not take the package back .finally he called his supervisor and came back and said he was taking it back.But on Wednesday with what appears to be a supervisor  attempting to deliver the package again and i told him nothing has changed sense yesterday.

Sometimes the envelopes contain multiple contracts in combined amounts of over $100,000. If the contract doesn't make it to the bank, we do not get paid. UPS has lost SIX packages, which were all shipped next day air, within the last 60 days. Two of which were for the same customer for two purchases about a month apart. This is getting ridiculous, and embarrassing having to call customers back to re-sign because our courier lost all their paperwork... Worse yet, all of their extremely private personal information is lost in limbo somewhere, unaccounted for.

UPS used to be pretty decent, but in this past year, they have fallen to lows I never expected. In this past year, I've had 3 different shipments from 3 different locations that have been delayed for 2-3 weeks with no explanation. Most recent fiasco... I ordered from Amazon, package was picked up by a local carrier (but had the UPS label on it). Local carrier dropped it at the Memphis location 1 hour later. Aug 12 8pm. I live 190 miles west of Memphis in central Arkansas (and yes, our roads are paved). I waited 2 days as I figure that would be sufficient time to get the delivery within what used to be normal time. Third day, I contact Amazon who pushed me over to UPS and UPS pushed me over to the local carrier, even though UPS received the package, which had a UPS label on it. UPS says they can't do an investigation as the request has to start with the original carrier... what?? As a retired logistics manager, that made no sense to me, but the UPS folks try to hide behind some "unknown" contract with the local carriers. So now I'm caught in a 3-way finger pointing contest: Amazon-local carrier-UPS. It's now Aug 26 which means the package has been sitting at the UPS Memphis location for 14 days, and no one seems to know where the package is, even though I gave them the UPS label number. UPS wants me to go back to the local carrier and have them file an investigation... again WHAT?? This isn't the UPS I used to use back in my distribution center a few years back. I know it isn't the guy/gal who drives the truck, it's the internal organization and those in the distribution facility who can't get their acts together. Amazon is absolutely no help, and they've fallen to very low customer service in the past couple of years also. The local carrier said "hey, I picked it up from Amazon and took it to UPS" in about an hour's time... I'm no longer part of the situation.
Bezos is probably correct with his latest Yahoo statement: Amazon will probably be bankrupted in a couple of years. You bet, cause I'm not renewing my Prime membership and I'm looking to other suppliers for future business.

This morning received text alert it is being returned to the shipper. Customer service absolutely no help. Advised that they sent messages to the local branch and would return call by 10AM. I asked for a supervisor, they seemed more interested in resolving and indicated she couldn't reach anyone at the local branch.

I waited 12 weeks for this item only to have it most likely returned to the sender.

I had been looking for a way to control shipping logistics for over a year before speaking with my local Postmaster and identifying this service. I have solved a big problem for us in shipping and receiving, improved our delivery performance, and feel good that I'm supporting the postal service. Now, if someone wants to ship to my home or use a private carrier, they contact me directly to arrange this; I can choose my preferred private carrier at that time. I wish it was easier to choose your shipping company - nearly all of our problems in logistics are attributed to a particular one - but this is a solution that has gone a long way in that direction for us.

Ever try to reach a live person regarding a package issue? Their phone menu is strategically set up to try and keep you from reaching a live person. If you hit random buttons, you can get the automation to say, "I can connect you to an agent, but you must first enter your tracking information." Yet when you enter the tracking number, you never actually get the option of reaching the promised agent at all. Instead it disconnects you 100% of the time.

If you want to reach a live person, do NOT go down the "track a package" option. Instead hit other buttons like, "Ship a package" or something else and then start hitting the zero button. Sure as shit, you'll get a live person, and they can see every button you've pressed along the way. I was told this by an agent just a few minutes ago! When I explain how horrible the menu is, I'm told something like, "I'll make sure I report that so we can get it fixed." To which I replied, "It's literally been this way for YEARS, and I guarantee that it's been reported a thousand times. But the powers that be literally don't want it changed. So when UPS goes belly up someday, people like me will be like, "Well of course they did; just look at how they conduct business!"

Two different purchases shipped out on the same day, a domestic one from Florida, and one coming from the UK via DHL. The DHL package arrived on Friday of that week, while the UPS passed up my residence and delayed a day. The next day, as the truck pulls in through the gate, I get an update that there is a delay due to an exception. I call customer service, and they tell me that the package was never in the truck, the app is just funny like that, and that TSA has decided to screen my package until further notice. We're now heading into Monday, and as two hurricanes threaten to delay my package further, I still have no answers from UPS.

So beware, if you're planning on doing business through UPS, TSA can allegedly hold your packages hostage, even though they're shipped domestically. If you're wondering, it's not Chinese toothpaste, a live animal, an invasive plant, drugs, or explosives. It's a garment. f%@king assholes.

TO ANYONE READING THIS: Im begging you, do yourself a favor and use any other service available, UPS will delay, lose, and damage your package and they do not care at all.

I've been forced to use UPS three times this month for various business dealings. The first time, the package was missorted FIVE TIMES and the rep told me there was nothing he could do and then he chuckled like it was funny? Just bizarre. The second time it was missorted twice, then was thrown in the dirt like trash near my house.

This third package, I unfortunately was forced to use UPS because I needed next day delivery and it was the only available option for an official government record. How stupid of me to think that this actually meant anything. Its now 4 days since the scheduled delivery date and noone knows where it is. Customer service is suddenly unresponsive when I mention the word refund (which, by the way, they have a no-questions-asked refund if their next day delivery guarantee is not met).

This company is a joke. If I performed even 10% this incompetently at my job, I would be out on my ass in less than a week.

I open a case (per UPS protocol) and never get updates or any calls back from the particular department that is supposed to help. Everyone there just says you have to talk to “this department, sorry” but I can never speak to them!!! I am not over exaggerating when I say EVERYTIME UPS is supposed to provide the service I paid them to do (ship products) they fail horribly. There are two options when UPS delivers my packages and it's a guarantee everytime, first being that the product will be broken due to incompetent handling and drivers or second being it just won't be delivered in the first place. UPS representatives have given me appalling attitudes when I have to go on the never ending chase to pickup my package from their poorly managed facilities..oh yea, and they hang up on customers after they display an absolute lack of knowledge on government regulations and company policies. I've once had the unfortunate opportunity to use their drop off location service in order to avoid the incompetence of my local UPS turd driver and instead of delivering to the CVS they listed on their very own website, they delivered it to a different CVS somehow...apparently all UPS drivers are incompetent turds. I've called customer service which is always going to be someone who doesn't know english well and also has ZERO ability to actually fix anything. I've been told countless times I'd be called back and never have recieved any calls, I've filled complaints online and never recieved responses. I truly don't know how such a terribly run company is in existence. I've had ZERO problems with FedEx, they will even call me to ask where I want my package. I've had a few problems with USPS, but not nearly the same amount as with UPS. Stop using their service and use the other options that can actually accomplish the job you paid them to do.

I figured it was worth it to get my important documents back quickly. However, the return package tracking status is "Shipment Ready for UPS" which means absolutely nothing. I assumed that UPS would have a daily pickup at this large government building but now I'm told I have to pay additional money for a pickup. Are you kidding me? I ordered something for my friend's birthday two weeks ago. It was supposed to be out for delivery today, but around noon the tracker started displaying this error message:

'The apartment number is either missing or incorrect. This may delay delivery. We're attempting to update the address.'

My address has been the same for five years and has miraculously had dozens of UPS packages delivered to it with no issues, so this was weird. Checked on the site I purchased from, the UPS MyChoice portal, and PayPal, but all of them had the correct address displayed.

I then called UPS and tried to figure out what was going on. On their end, my package was indeed missing the apartment number, but I don't see how that could happen if it was correct on everything else.

Just hoping I get the package today as scheduled or tomorrow so I can at least get it to my friend on their birthday.

The scheduled delivery date is a joke and so is the tracking system. Was supposed to receive a package today by 9pm. Yesterday it changed to delivery tomorrow instead. This morning it changed to unknown. Called UPS at noon and they said it had arrived in my country and city and would be delivered in 2 days. A few hours later I look online and it is still in the origin country and never left and delivery not for another 5 days. Call again and the rep says it's at the airport in origin country and should arrive in my country tomorrow. 5 minutes later look online and it has just arrived in an entirely different country overseas and scheduled delivery is updating. So at best will be 6 days late and possibly never. Would be nice if I could understand the reps. Please hire people that speak english as a first language and arent using phone technology from 1980 thanks. Between the static and heavy accent I had to ask the same questions several times. Although probably no point since each person provides different, albeit always wrong, information.

My package was scheduled to come in yesterday, and I got off work early, so I thought I'd wait outside and get some yard work done. Past experience has taught me that UPS won't even knock and just drop off the "You weren't here to accept the package" notice.
At 2pm, I received a notification that "delivery was attempted, COD not paid" when no truck even had passed the building. I called and from what I could glean from the corporate doublespeak in the flowchart the woman was reading from is that they don't actually need to attempt a delivery if they don't think it will go through.
I had paid the COD 3 days ago over the phone. Over the phone because every time I tried through their site, it refused to accept my payment. I had tried paying through both paypal and credit card and it said there was an error no matter the method. I had even gotten the receipt in my email days prior to delivery regarding my payment of the brokerage fees.
I really wish the company I was dealing with used a more reliable method of shipping, one that wouldn't charge an exorbitant amount for brokerage, refuse to deliver despite payment of the fees and refuse to give me a straight answer about it all.
I'd rather deal with the regular mail service, or DHL, or have my package tied to pigeons and released in my general direction than to deal with this garbage again.

I've got a $3,000 piece of Equipment(freight shipping) that has been at my local UPS facility since last Thursday(it's monday at 9:45pm). They wouldn't let me pick it up on Friday and said my appointment for delivery is Monday(today) 10am - 6pm... Ok, so, take a day off from work. Fine. After 6pm I started trying to call and figure out where my machine was but no one could help me. UPS said they aren't trained in freight shipments and transferred me to UPS FREIGHT. They said they would contact the dispatcher/driver and get back to me within the hour.. yeah, that never happened. 9 pm rolls around and I start calling customer service only to get an automatic response that says we are open until 9:30, please call back again during normal business hours. WHAT?!

So, now I'm up waiting because I have no Idea if they are going to attempt a super late delivery or if they are going to make up some bullshit excuse tomorrow. Tracking says still on the truck out for delivery too

I just wanted to pick it up. But it took them more than a day to process the pickup request even though they 'know where it is' and just didn't get to it because of a backup due to COVID.

Now I'm no longer in town and requested the address to be changed. It's been 12 hours and the address change request is still pending. Asked them how long it takes and they said 'If it's done before 7 pm it will arrive the next day. If not, it will arrive in 2 business days."

Used to be a great company to deal with, now it is reaching a level of suckatude that is below any ranking.

Had a package shipped from Chicago IL area that reached NJ in 1 day and will now sit for 4 days before being delivered to the next town over from where was received. It seems like they sit on packages that get in early so that customers don't get comfortable with early deliver and thus will have to pay extra for shipments to get quicker delivery.

I called customer service who confirmed this. She told me they are following the delivery schedule for the class of service. In other words if ground transportation can take 3-5 days they will make sure it doesn't arrive early so that they can force upcharged expedited deliver, which is often later than expected.

Of course you are talking to an agent in the Phillipines who doesn't even understand why you are upset as they are happy to get a deliver at any point. Globalization only provides greater profits for the corporation with no benefit for the customer. It might possibly benefit the stockholder, but that is mostly to the benefit of the management personnel who get stock options and not the general investor.

There is great room for competition here, thought tough for startups in this space. While not a fan of Amazon, it is a much more response organization than UPS, which even the Post Office is better than. Just look at how many packages UPS delivers through the Post Office.

UPS is unreliable. I ordered an item from my local phone carrier to get some new products, i get my shipping date of Saturday August 15 by 12PM since the service is next day air. The package was out for delivery at 8AM so I wait until 12PM and nothing I waited the entire afternoon and evening until 8-9PM because that’s the latest a driver can deliver. Then my package went from Out for Delivery to in transit still holding the Saturday and 12PM delivery it’s now Sunday and now it tells me that the scheduled delivery is now showing information unavailable. The thing is I never got any email or notification or anything on the tracking that says it was delayed or that a delivery attempt was made. This shows that UPS doesn’t care about your time and never attempt to deliver or fix anything they just give you false info.

I ordered a few things online in the past week, just some fun shopping stuff. Two packages were meant to be delivered today, and yet when I get home I find a “sorry we missed you” notice. Since when do Sephora and Old f%@king Navy require signatures to be delivered??! Just look at the note on the building door and take them to the back doors along with *everybody elses* shit! What is going on?!

UPS has been totally unreliable, the truck was on my street today, my box was on the truck and I stopped him to ask why he did not stop at our house for the delivery. Tells me some bull shit story he was doing 2nd day delivery first and he would stop by in a few hours. What a load of bull shit, not to say he never came by. I hate UPS!!! Will NEVER use them, FEDEX all the way!

I have learned by observation and investigation since late June, by having to reorder the same item 3 times to get it delivered what is happening. “Tracking” to wrong destinations, bad scanning, false delays, cabcelling through Amazon and reordering multiple times, then through the vendor (an 8x10 indior-outdoir rug). Had to approach truck and tell him what it was - it was on the truck! Now happened again - 4 out of 5 times misdelivered.

Last week FedEx fu&$ked me and this week it’s UPS. I’ve been waiting for an expensive important package from CA for over ten days. The tracking has said “In Transit” since August 6, and it’s now August 15. Unless it’s coming on the back of a mule from California I assume it’s lost. It NEVER fails. The orders I don’t need or am not waiting at home for are delivered on time. The ones I am counting on to be delivered properly never are. I have tried calling UPS customer service and get lost in stupid automated menus. If I could reach through the phone and choke the shit out of the UPS menu girl 👧 I would. Never was able to reach a human. The computer girl said “your package is in transit. Goodbye.” and the line was disconnected. Asked for representatives multiple times. Disconnected. So I suppose “due to COVID” they don’t have any humans helping out with customer service these days. In my experience the USPS does the most reliable job with the least resources and help. So I basically have no resolution. Just accept your getting f%@ked ask for a refund from the shipper and start all over again. FU&)k FED ex and F&$k UPS. 🖕🏽

The work conditions at UPS facilities lack any automation and therefore put unnecessary burdens on their workers. 4. UP S does not allow unions, unlike the post office. UPS My Choice preference states leave at front door. However, they usually leave it at the side door, and the last two days they have left it out in the sun/rain (I'm in Florida), at front gate, by the road for anyone to take. Today's package was medication for my 75 year old mother. Calling or writing in to complain gets you... 'we will call the center and let them know'...'someone will call you back'. No one ever calls back. They don't care. I wish when I ordered from Amazon or other places I could choose to not use UPS.
